1. Service Publisher and Legal Notices
The Organova application, accessible at app.organova.music (hereinafter the "Service" or the "Application"), is a virtual pipe organ and, more broadly, an online virtual keyboard, published by LuneStudioSAS (hereinafter referred to as "Organova" or the "Publisher") VAT number - F R 8 4 9 3 4 4 1 4 7 9 8 - Contact: contact@organova.music
The Service is hosted by DigitalOcean LLC (digitalocean.com), on servers located within the European Union.
2. Purpose of the Service
The Organova Application, accessible at app.organova.music, is a virtual pipe organ and, more broadly, an online virtual keyboard, allowing users to play, from a web browser, a library of keyboard instruments (pipe organs, harpsichords, pianos, electronic and synthesised instruments). Sounds are produced either from sampled recordings of real instruments, or by algorithmic generation.
The Service is intended for personal or professional musical use: instrumental practice, study, accompaniment, rehearsal, and private or public performance.
3. Acceptance and Modifications of these Terms
Use of the Service implies the full and unreserved acceptance of these Terms of Service (hereinafter the "Terms"). Any user who does not accept all or part of the Terms must refrain from using the Service.
Organova reserves the right to modify the Terms at any time. Users holding an account will be notified of substantial modifications by email or by notification within the Application, with reasonable prior notice. Continued use of the Service after the modifications come into effect constitutes acceptance thereof.
4. Access to the Service
4.1. Eligibility
The Service is open to natural persons aged 15 or older. Minors under the age of 15 may only register with the prior authorisation of a holder of parental authority, who remains responsible for any use made by the minor.
4.2. User account
Access to all or part of the Service may require the creation of an account. The user undertakes to provide accurate information and to keep it up to date. The user is responsible for the confidentiality of their credentials and for any activity carried out from their account.
The user may terminate their account at any time, without notice or justification, through the Service interface or by contacting the Publisher.
4.3. Business model
The Service is currently provided free of charge. Organova reserves the right to modify this business model, in particular by introducing paid features, a subscription, or a freemium offering. Any change to the business model will be notified to users with reasonable prior notice, and access to paid features will be conditional only upon prior acceptance of the then-applicable pricing and sales conditions.
5. Intellectual Property — Organova Application
All elements constituting the Service — source code, graphical interface, design, visual identity, the "Organova" trademark, texts, logos, illustrations, and sounds produced by algorithmic generation — are the exclusive property of Organova or are used under rights duly granted to Organova.
The "Organova" trademark is a registered trademark. Any reproduction or unauthorised use is prohibited.
No provision of these Terms shall be interpreted as transferring to the user any intellectual property right over the Service.
6. Intellectual Property — Instruments and Samples
6.1. Composite nature of the library
The sound library provided by the Service consists of three categories of instruments, subject to distinct legal regimes:

Proprietary instruments: recordings produced by Organova, of which the company holds all patrimonial rights.

Algorithmically-generated instruments: sounds produced by an algorithmic generation specific to Organova, without recourse to pre-existing recordings.
-
Third-party instruments: recordings produced by third parties, made available to Organova either under open licences (notably Creative Commons), or under written authorisations granted by their authors.
The complete list of instruments and the regime applicable to each is set out in Appendix 1 of these Terms.
6.2. Third-party ownership rights
Third-party instruments remain the exclusive property of their respective authors. Organova claims no ownership right over these works and merely integrates them into the Service in compliance with the licences or authorisations governing them.
6.3. Regime applicable to samples under open licence
Third-party instruments distributed under a Creative Commons licence (BY, BY-SA, or variants) are governed by the terms of their respective licence. Users are invited to consult Appendix 1 to identify the licence applicable to each instrument and to comply with the corresponding conditions (attribution, redistribution under the same licence where applicable, etc.).
The usage restrictions set forth in Article 7 apply to these instruments only insofar as they are compatible with the original licence. In case of contradiction, the terms of the original licence shall prevail.
7. Authorised and Prohibited Uses
7.1. Authorised uses
Within the normal use of the Service, users may:

Play the instruments made available, in private or in public;
-
Make audio and video recordings of their performances, using equipment external to the Service;

Distribute and exploit such recordings for personal, educational, liturgical, or artistic purposes, whether online or offline.
For any audio or video recording publicly distributed (in particular on sharing platforms, social networks, or physical media), the user undertakes to credit Organova in one of the following two ways, at their choice:

Either by making the Application interface visible in the distributed video content, the on-screen display of the Organova logo and name serving as the credit;

Or, when the interface is not visible (audio-only recording, edited footage without interface capture, etc.), by mentioning Organova in a legible manner in the title, description, credits or sleeve notes of the recording, for example in the form: "Recorded with Organova — app.organova.music".
For third-party instruments distributed under a Creative Commons licence or under specific written authorisation, additional attribution obligations toward the authors of the samples may apply; users are invited to refer to Appendix 1 to identify the appropriate credits.
7.2. Prohibited uses
Save as otherwise provided by the licence applicable to a third-party instrument (see Article 6.3), the user is strictly prohibited from:

Extracting, copying, downloading, permanently retaining, or reusing the audio files constituting the sampled instruments, whether they are stored on Organova's servers, transmitted to the browser, or temporarily retained in the local cache;

Reproducing, distributing, transmitting, lending, renting, making available, or commercialising, in any form whatsoever, all or part of the samples constituting Organova's proprietary or algorithmically-generated instruments;

Integrating the sounds of the Service into any other software application, virtual instrument, or product intended to be distributed or commercialised;
-
Performing reverse engineering, decompilation, or disassembly of the Service, except within the limits strictly provided for by Article L. 122-6-1 of the French Intellectual Property Code;

Circumventing or attempting to circumvent any technical protection measures put in place;
-
Using the Service in a manner that impairs its operation, its security, or the rights of third parties;
-
Attempting unauthorised access to the servers, accounts, or data associated with the Service.
The mere technical accessibility of audio files within the user's browser shall in no case constitute contractual authorisation to extract or reuse them.
8. Personal Data
8.1. Data controller
Organova acts as the data controller for the personal data collected through the Service. It may be contacted at contact@organova.music for any question relating to data protection.
8.2. Data collected and purposes
The following categories of data are collected and processed:

Registration and account data: email address, username, hashed password, and where applicable first name and surname;

Connection and usage data: connection logs, IP address, browser type, instruments used, aggregated usage statistics;

Payment data, where applicable, when the Service includes paid features (handled by a specialised payment provider, with no direct retention of banking data by Organova).
The purposes of the processing are the following:

Provision, maintenance, and improvement of the Service;
-
Management of user accounts;
-
Audience measurement and statistical analysis of usage;
-
Communication relating to the Service;
-
Compliance with applicable legal and accounting obligations;
-
Management of payments and invoicing, where applicable.
8.3. Legal bases
The processing operations rely on the performance of the contract concluded between the user and Organova (these Terms), on the Publisher's legitimate interest in maintaining and improving its service, on the user's consent where required, and on compliance with applicable legal obligations.
8.4. Processors
Organova relies on the following processors for the handling of personal data:

DigitalOcean LLC (infrastructure hosting);

PostHog (audience measurement and usage analytics);
-
Stripe, where applicable in the future (payment processing).
Each of these processors is bound to Organova by contractual undertakings consistent with the General Data Protection Regulation.
8.5. Retention period
Account data is retained for as long as the account is active, then for a maximum period of 24 months following its termination, save for any longer legal retention obligations (in particular accounting and tax obligations). Audience measurement data is retained in aggregated and anonymised form beyond 13 months.
8.6. User rights
In accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 as amended, users have a right of access, rectification, erasure, restriction, portability, and opposition with respect to the processing of their personal data. These rights may be exercised by contacting Organova at the address indicated in Article 8.1.
Users also have the right to lodge a complaint with the French Data Protection Authority (Commission nationale de l'informatique et des libertés — CNIL, www.cnil.fr).
8.7. Trackers and audience measurement
The Service uses trackers (cookies, browser local storage) for its operation and for audience measurement. Users are informed of their use and may, where applicable, express their preferences through the dedicated interface.
9. Availability, Warranties, and Liability
9.1. Availability
Organova uses reasonable means to ensure the availability of the Service, without any guarantee of absolute continuity. The Service may be subject to interruptions for maintenance, updates, or for any technical reason or event of force majeure. No compensation may be claimed in respect of such interruptions.
9.2. Warranties
The Service is provided "as is". Organova does not warrant that the Service will be error-free, that it will meet a specific use intended by the user, or that the sounds produced will be identical in all circumstances to those of the real instruments sampled.
9.3. Liability
Organova may not be held liable:
-
For any indirect damage, loss of data, loss of opportunity, or immaterial harm resulting from the use of, or inability to use, the Service;
-
For any misuse of the Service by the user, in particular in breach of these Terms or of the licences applicable to third-party instruments;
-
For any unauthorised use of a user's account resulting from a breach by that user of their confidentiality obligations.
Within the limits permitted by law, Organova's liability, should it be engaged in connection with the use of the Service provided free of charge, shall be limited to the direct and certain damage actually suffered. When the Service is provided for a fee, such liability shall be capped at the amount paid by the user over the twelve months preceding the triggering event.
10. Suspension and Termination by the Publisher
Organova reserves the right to suspend or terminate access to the Service, without notice or compensation, with respect to any user who breaches these Terms, in particular in cases of unauthorised extraction or redistribution of samples, attempted breach of the security of the Service, or any other abusive behaviour.
11. Changes to the Service
Organova reserves the right to make changes to the Service, including modifying, adding, or removing features, instruments, or content, in particular in case of withdrawal or modification of the authorisations granted by the authors of third-party instruments. No compensation shall be due on account of such changes.
12. Applicable Law and Dispute Resolution
These Terms are governed by French law.
In the event of a dispute, the parties shall endeavour to reach an amicable settlement. Failing this, the French courts shall have jurisdiction, subject to the mandatory rules applicable to consumers domiciled in another Member State of the European Union.
Pursuant to Article 14 of Regulation (EU) No 524/2013, the European Commission provides an online dispute resolution platform, accessible at: ec.europa.eu/consumers/odr.
13. Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, such invalidity shall not affect the validity of the remaining provisions, which shall remain fully in force.
Organova's failure to enforce any breach by the user of any obligation under these Terms shall not be deemed a waiver of its right to do so subsequently.

library grows.
